Checks & Balances — How Each Branch Controls the Others

The Constitution divides power among three branches so no single branch becomes too powerful.

How Congress checks the President:

Override a presidential veto (2/3 majority)

Control the federal budget

Senate confirms presidential appointments

Senate ratifies treaties

Congress can impeach and remove the President

How the President checks Congress:

Veto legislation

Call Congress into special session

Recommend legislation

How the courts check both:

Declare laws unconstitutional (judicial review)

Declare executive actions unconstitutional

Q: What stops one branch of government from becoming too powerful?
A: Checks and balances / separation of powers

Impeachment process:

House votes to impeach (simple majority)

Senate holds the trial (2/3 majority to convict and remove)

Presidents impeached: Andrew Johnson, Bill Clinton, Donald Trump (twice). None were removed by the Senate.
